Common use of Authority’s Best Value Duty Clause in Contracts

Authority’s Best Value Duty. 67.1 The Contractor acknowledges that: the Authority is subject to the Best Value Duty; and the provisions of this Clause 67 are intended to assist the Authority in discharging its Best Value Duty in relation to the Services. 67.2 The Contractor shall throughout the Term use its best endeavours to secure continuous improvement in the way in which the Services are provided, having regard to a combination of economy, efficiency and effectiveness. 67.3 The Contractor shall undertake or refrain from undertaking such actions as the Authority shall reasonably request to enable the Authority to comply with Part 1 of the 1999 Act, including: (a) supporting and assisting the Authority in preparing Best Value Performance Plans and conducting Best Value Reviews in relation to all or any of the Services; (b) complying with requests for information, data or other assistance made by the Authority in pursuance of its Best Value Duty including those to: enable the Authority to prepare Best Value Performance Plans; enable the Authority to conduct a Best Value Reviews; facilitate the audit of the Authority’s Best Value Performance Plans by the Authority’s auditor pursuant to Section 7 of the 1999 Act; facilitate the Authority preparing any statement in response to an Authority’s auditor’s report, pursuant to Section 9 of the 1999 Act; facilitate any inspection undertaken by any Best Value Inspector in connection with the Best Value Duty in respect of the Services, including any inspection undertaken with a view to verifying the Authority’s compliance with its Best Value Duty pursuant to Sections 10 and 11 of the 1999 Act; assist the Authority in relation to any action taken by the Secretary of State under Section 15 of the 1999 Act; enable the Authority to comply with any Government Departmental Direction; enable the Authority to report on the Best Value Performance Indicators; assist the Authority in any Comprehensive Performance Assessment; enable the Authority to comply with the Publication of Information Direction 2000 (England and Wales); (c) complying with all requests by the Authority to procure the attendance of officers or employees of the Contractor or any of the Staff at any meetings of the Authority at which the Services are to be discussed (but not, other than in exceptional circumstances, more than twice in any one year); and (d) permitting any Regulatory Body, in connection with the exercise of its statutory powers and duties, at all reasonable times and upon reasonable notice, access to: the Authority Property; any document or data relating to the Services; and any Staff.

The Contractor shall undertake or refrain from undertaking such actions as the Authority shall reasonably request to enable the Authority to comply with Part 1 of the 1999 Act, including: (a) supporting and assisting the Authority in preparing Best Value Performance Plans and conducting Best Value Reviews in relation to all or any of the Services; (b) 2.3.1. complying with requests for information, data or other assistance made by the Authority in pursuance of its Best Value Duty including those to: enable the Authority to prepare Best Value Performance Plans; enable the Authority to conduct a Best Value Reviews; facilitate the audit of the Authority’s Best Value Performance Plans by the Authority’s auditor pursuant to Section 7 of the 1999 Act; facilitate the Authority preparing any statement in response to an Authority’s auditor’s report, pursuant to Section 9 of the 1999 Act; : (a) facilitate any inspection or audit undertaken by any Best Value Inspector Relevant Authority in connection with the Best Value Duty in respect of the Services, including any inspection undertaken with a view to verifying the Authority’s compliance with its Best Value Duty pursuant to Sections 10 and 11 of the 1999 Act; ; (b) facilitate the Authority preparing any statement, in response to an Authority’s auditor's report; (c) assist the Authority in relation to any action taken by the Secretary of State under Section 15 of the 1999 Act; enable the Authority to comply with any Government Departmental Direction; State; (d) enable the Authority to report on the Best Value Performance Indicators; assist the Authority in Indicators and any Comprehensive Performance Assessment; enable the Authority to comply with the Publication of Information Direction 2000 (England and Wales)other data requirements that may be prescribed by any Relevant Authority; (ce) complying with all reasonable requests by the Authority to procure the attendance of specific officers or employees of the Contractor or any sub- contractor (or to procure attendance of the Staff any of its or their sub-contractors) at any meetings of the Authority at which the Services are to be discussed (but not, other than in exceptional circumstances, more than twice in any one year); anddiscussed; (df) permitting any Regulatory BodyBest Value Inspector or other Relevant Authority empowered to inspect the Authority’s compliance with Part 1 of the 1999 Act, in connection with the exercise of its his statutory powers and duties, at all reasonable times and upon reasonable notice, access to: : (i) the Authority Property; Facility; (ii) any document or data relating to the Services; and ; (iii) the personnel of Contractor or any StaffSub-Contractor.

The Contractor shall shall: take all reasonable steps necessary to facilitate, support and assist the Authority in complying with Part 1 of the 2003 Act; undertake or refrain from undertaking such actions as the Authority shall reasonably request to enable the Authority to comply with Part 1 of the 1999 2003 Act, including: (a) supporting and assisting the Authority in preparing Best Value Performance Plans and conducting Best Value Reviews in relation to all or any of the Services; (b) including complying with requests for information, data or other assistance made by the Authority in pursuance of its Best Value Duty including those to: enable the Authority to prepare Best Value Performance Plans; enable the Authority to conduct a Best Value Reviews; facilitate the any inspection or audit of the Authority’s Best Value Performance Plans undertaken by the Authority’s auditor pursuant to Section 7 of , the 1999 Act; facilitate the Accounts Commission, Audit Scotland or any Relevant Authority preparing any statement in response to an Authority’s auditor’s report, pursuant to Section 9 of the 1999 Act; facilitate any inspection undertaken by any Best Value Inspector in connection with the Best Value Duty in respect of the Services, including any inspection undertaken with a view to verifying the Authority’s compliance with its Best Value Duty pursuant to Sections 10 and 11 Part 1 of the 1999 Act2003 Act and/ or Section 102 of the Local Government (Scotland) Act 1973; facilitate the Authority preparing any statement, in response to an Authority’s auditor's report; assist the Authority in relation to any action taken by the Secretary of State under Section 15 of Scottish Ministers or the 1999 Act; enable the Authority to comply with any Government Departmental DirectionScottish Government; enable the Authority to report on the Best Value Performance IndicatorsIndicators and any other data requirements that may be prescribed by any Relevant Authority; assist the Authority in any Comprehensive Performance Assessment; enable the Authority to comply with the Publication of Information Direction 2000 (England and Wales); (c) complying with all requests by the Authority to procure the attendance of specific officers or employees of the Contractor or any sub-contractor (or to procure attendance of the Staff any of its or their sub-contractors) at any meetings of the Authority at which the Services are to be discussed (but not, other otherwise than in exceptional circumstances, more than twice [insert number] in any one year(1) Contract Year); and (d) permitting any Regulatory BodyBest Value Inspector [or other Relevant Authority empowered to inspect the Authority’s compliance with Part 1 of the 2003 Act], in connection with the exercise of its his statutory powers and duties, at all reasonable times and upon reasonable notice, access to: the Authority PropertyFacility; any document or data relating to the Services; and the personnel of Contractor or any StaffSub-Contractor; subject to paragraph 2.3.2 of this Schedule Part 15, comply with the guidance referred to in Section 2 of the 2003 Act as directed by the Authority from time to time.
