Authorized Operators. A contractor shall be deemed authorized to Use the GIS Data Products if such Use is incidental to a larger relationship between the contractor and the Customer, and is Used for purposes no greater than reasonably needed to achieve the objectives of an actual project undertaken in connection with that relationship, and the contractor has agreed in writing to be bound by the provisions of this Agreement.

Authorized Operators. CUSTOMER shall only permit individuals to operate a piece of Equipment if that individual possesses the necessary experience, training, certification and/or licensure to safely do so. CUSTOMER releases, holds harmless and will indemnify COMPANY, its subsidiaries and affiliated companies, their officers, agents and employees against any and all loss, liability, expense, including reasonable attorneys’ fees, damages including, but not limited to, property damage, personal injury, or strict liability, resulting from, or allegedly resulting from, an operator’s lack of such experience, training, certification and/or licensure.
