Common use of Availability of Books and Records Clause in Contracts

Availability of Books and Records. Business Associate agrees to make its internal practices, books and records relating to its uses or disclosures of the PHI available to Participant, or, if directed in writing, the Secretary for purposes of determining compliance with Applicable Law, subject to attorney-client and other applicable privileges.

Availability of Books and Records. Business Associates shall provide Subscriber a copy of any PHI that Business Associate provides to the Secretary upon request.

Business Associate hereby agrees to make its internal practices, books and records relating to its uses the use and disclosure of PHI received from, or disclosures of created or received by Business Associate on behalf of, the PHI Covered Entities available to Participant, or, if directed in writing, the Secretary for purposes of determining the Covered Entities' and Business Associate's compliance with Applicable Law, subject to attorney-client and other applicable privilegesthe Privacy Regulations.
