Common use of Availability of Disclosure Information Clause in Contracts

Availability of Disclosure Information. Business Associate will maintain the Disclosure Information for at least 6 years following the date of the accountable disclosure to which the Disclosure Information relates. Business Associate will make the Disclosure Information available to Health Plan within 30 calendar days following Health Plan’s request for such Disclosure Information to comply with an individual’s request for disclosure accounting.

Availability of Disclosure Information. Business Associate will maintain the Disclosure Information for at least 6 years following the date of the accountable disclosure to which the Disclosure Information relates. Business Associate will make the Disclosure Information available to Health Plan Covered Entity within 30 60 calendar days following Health PlanCovered Entity’s request for such Disclosure Information to comply with an individual’s request for disclosure accounting.

Unless otherwise provided under the HITECH Act, Business Associate will maintain the Disclosure Information for at least 6 years following the date of the accountable disclosure to which the Disclosure Information relates. Business Associate will make the Disclosure Information available to Health Plan Participant within 30 calendar 10 days following Health PlanParticipant’s request for such Disclosure Information to comply with an individual’s request for disclosure accounting. In addition, where Business Associate is contacted directly by an individual based on information provided to the individual by Participant and where so required by the HITECH Act and/or any accompanying regulations, Business Associate shall make such Disclosure Information available directly to the individual.
