Common use of Availability of Funds Clause in Contracts

Availability of Funds. Payment under this Contract is contingent on the funds contemplated in this Contract being made available to the COUNTY. In the event funds to finance all or part of this Contract do not become available, obligations of each party to this Contract may be terminated upon receipt by the AGENCY of the COUNTY’S notice. The COUNTY shall be the sole and final authority as to the determination of the availability of funds.
