Common use of AVAILABILITY OF RESOURCES; COOPERATION Clause in Contracts

AVAILABILITY OF RESOURCES; COOPERATION. Each Party shall maintain laboratories, offices and/or other facilities reasonably necessary to carry out the activities to be performed by such Party pursuant to the European Development Program or the U.S. Development Program, as applicable. Upon reasonable advance notice, each Party agrees to make its employees reasonably available at their respective places of employment to consult with the other Party on issues arising in connection with any request from any regulatory agency, including, without limitation, regulatory, scientific, technical and clinical testing issues. The cost of such availability of employees shall be borne by the requesting Party.

The cost of such availability of employees shall be borne by the requesting Party.
