Avoidance. The parties agree that: (a) they will make every effort to ensure that disputes do not arise; (b) if a dispute does arise, they must make every reasonable effort to resolve the dispute in accordance with this clause 17 and without recourse to litigation or arbitration proceedings; and (c) the provisions of clauses 17.1 and 17.2(b) do not apply to litigation proceedings for injunctive, interlocutory or declaratory relief.
