BACKUP POWER. Prior to Day One of Delivery, the BWS shall provide supplemental power system at its own expense. The supplemental power system will be used in case of power interruptions not attributable to BWS. It must be capable of delivering 100% of the required volume as indicated in Section 1 of Article VII. BWS shall submit to MCWD a certification from the power provider within twenty-four (24) hours after occurrence of the power interruption.

BACKUP POWER. Lessor acknowledges that Lessee’s entire operation (including all facilities located on other properties) is dependent on the telephone and computer systems located in the space being leased by Lessee pursuant to this Lease. Consequently, Lessor hereby agrees that if there is ever a power failure, Lessor will, to the extent it is permissible to do so under all applicable laws and ordinances, and if Lessor’s equipment will permit Lessor to do so, and to the extent Lessee so requests at the time, supply Lessee’s telephone and computer systems with whatever backup power Lessor has available to it. Lessee acknowledges that its rights hereunder will in all events be subordinate to the fire and life-safety needs of the Building. Moreover, Lessee acknowledges and agrees that all costs incurred in so supplying Lessee with backup power shall be paid by Lessee. Lessee acknowledges that Lessor is not required to install equipment to supply backup power, in excess of the equipment presently installed in the Building.
BACKUP POWER. NEON will provide Network Plus with a minimum of [**] hours of battery backup and generator power at each regenerator site. Failure to provide such power during the Initial Term shall be deemed an Outage for purposes of Section 5.3. During any Renewal Period, NEON shall offer to Network Plus such backup and generator power at a commercially reasonable rate. In addition, NEON shall permit Network Plus to install a generator plus at each facility and shall permit Network Plus to attach its own generator to such plug in the event Network Plus desires to do so.

BACKUP POWER. Landlord will provide to Tenant, at no additional charge, redundant power. Tenant shall have use of excess existing UPS service. Tenant, at its own cost and expense, shall have the right to install an additional UPS system in the current UPS room, and Tenant shall have the right to remove the system within thirty (30) days after expiration of the Term.
BACKUP POWER. In the event there is no Power, NEA shall arrange for backup power for the Facility at the same average cost as NEA obtains backup power for the NEA Plant including, but not limited to, energy charges, demand charges, transmission costs and distribution costs, less any applicable credits. BOC will reimburse NEA for such costs incurred for such backup power to the extent of BOC's use of such power and subject to NEA providing invoices from the utility providing such backup power as set forth herein. 5. SECURITY AND SAFETY REGULATIONS BOC, its agents, employees and subcontractors shall perform all obligations under this Agreement and all work and services in a safe and responsible manner and shall comply with all applicable safety laws and regulations promulgated by any Governmental Authority including, without limitation, the requirements of the Occupational Safety and Health Act of l970 ("OSHA") and the Construction Safety Act of 1969. BOC will adequately train all of its employees and subcontractors engaged in the work and services in all of the OSHA rules and regulations related thereto. Additionally, BOC, its agents, invitees, employees and subcontractors shall fully comply with the NEA Security and Safety Policies set forth in Schedule VI attached hereto. 6. ENVIRONMENTAL LIABILITIES; HAZARDOUS MATERIALS 6.1 NEA Obligations. NEA will be solely responsible for all claims, damages, losses, costs and expenses arising from the presence or release of Hazardous Material on, at or under the Facility or from noncompliance with applicable environmental Legal Requirements, including noise ("Environmental Liabilities"), in either case, existing, occurring or caused prior to the first date of the Initial Operating Period ("NEA Environmental Liabilities"). NEA shall indemnify BOC and its respective officers, directors, shareholders, employees and agents, from and against any and all NEA Environmental Liabilities. Prior to and during BOC's occupancy of the Facility, NEA shall advise BOC in writing of the existence of any existing contamination or remediation/removal orders or activities relating to the Facility, the Facility Site or the NEA Plant. 6.2
BACKUP POWER. Backup UPS and generator capacity for the Premises sufficient to provide in the riser on the floor of the Premises 90 kva of electrical power. If during the period from March 13, 2006 through March 31, 2008 Landlord and Tenant mutually determine that additional backup generator capacity is needed for the Premises, then Landlord shall allocate to the Premises such mutually determined additional capacity up to an additional 110 kva of electrical power to the Premises, and the Annual Basic Rent shall be increased by an amount equal to $0.06 per year per square foot of Agreed Rentable Area of the Premises per additional kva of electrical power allocated to the Premises.

BACKUP POWER. Company shall install an electric generator which starts ------------ automatically in the event of loss of conventional power to provide electric service to the Cable System head-end and associated equipment in the event of a power failure. Company shall provide battery backup power (or an electric generator) at all locations on the Cable System in the Public Ways where the loss of electric power might disrupt the provision of service within Municipality such that the Cable System shall operate for at least four (4) hours even if electric service from conventional utility lines is interrupted.
BACKUP POWER. NSPI agrees to connect certain appliances within the Home to the Equipment to provide such appliances with a backup power supply in the event of a power outage. The Customer will identify its preferred list of appliances to be connected to the Equipment and NSPI will determine which appliances may be connected to the Equipment, acting reasonably. NSPI's installer will connect the selected appliances to the Equipment. NSPI will reserve a minimum 20% of the battery nameplate capacity for Customer backup power. The Customer acknowledges that:
BACKUP POWER. Franchisee shall not use a permanent or semi-permanent internal combustion engine (such as a gasoline or natural gas-powered electric generator) to provide backup power at any point or points on the Network Facilities without Municipality's prior written approval. Such approval may be granted subject to conditions, such as relating to testing times (e.g., not in the middle of the night), screening, noise levels, and temperature and safe discharge of hot exhaust gasses. Municipality hereby grants Franchisee approval to use backup power generating devices, including devices with permanent or semi-permanent internal combustion engines, at its network hut sites and inside buildings or on land owned by Franchisee subject to the specific conditions provided for in the network hut leases entered into between Franchisee and Municipality for the use of land owned by Municipality, and any applicable building code requirements.
