Common use of Backwards Compatibility Clause in Contracts

Backwards Compatibility. (a) In addition to the warranties contained in Section 17 of this Contract, the Vendor represents and warrants that each Software Revision Level during the Term of this Contract will be Backwards Compatible with all existing in-service Equipment provided by the Vendor and the immediately preceding Software Revision Level of such Software made available to Customers by the Vendor. (b) In the event that Software supplied by the Vendor at any System Element Site at any time does not provide Backwards Compatibility as required by this subsection 11.3, then the Vendor will provide, without charge to the Owner, the most current Software Updates of the Software to each such System Element Location, and otherwise take such steps as may be necessary to achieve Backwards Compatibility.
