BASF Technology Stewardship and Enforcement. 2.1. BASF hereby agrees to provide to Grower the Incentive in the event that (1) Grower Group complies fully with the terms of the Agreement; (2) Grower does not terminate this Compliance Agreement pursuant to Section 4.2 below prior to harvest completion for the applicable production year; and (3) BASF does not terminate this Compliance Agreement pursuant to Section 4.3(b) below.
2.2. Grower represents to BASF that Grower Group acknowledges and understands the following:
