Basic Information Requirements. 9.5.1.1. CONTRACTOR shall provide information in a manner and format that is easily understood and readily accessible to clients. (42 C.F.R. § 438.10(c)(1)) CONTRACTOR shall provide all written materials for clients in easily understood language, format, and alternative formats that take into consideration the special needs of clients in compliance with 42 C.F.R. § 438.10(d)(6). CONTRACTOR shall inform clients that information is available in alternate formats and how to access those formats in compliance with 42 C.F.R. § 438.10. 9.5.1.2. CONTRACTOR shall provide the required information in this section to each client receiving SMHS under this Agreement and upon request. CONTRACTOR shall utilize the COUNTY’S website that provides the content required in this section and 42 C.F.R. § 438.10 and complies with all requirements regarding the same set forth 42 C.F.R. § 438.10. 9.5.1.4. CONTRACTOR shall use DHCS/COUNTY developed member handbook and client notices. (42 C.F.R. §§ 438.10(c)(4)(ii), 438.62(b)(3)) 9.5.1.5. Client information required in this section may only be provided electronically by the CONTRACTOR if all of the following conditions are met: 9.5.1.5.1. The format is readily accessible; 9.5.1.5.2. The information is placed in a location on the CONTRACTOR’S website that is prominent and readily accessible; 9.5.1.5.3. The information is provided in an electronic form which can be electronically retained and printed; 9.5.1.5.4. The information is consistent with the content and language requirements of this Agreement; 9.5.1.5.5. The client is informed that the information is available in paper form without charge upon request and CONTRACTOR provides it upon request within 5 business days. (42 C.F.R. § 438.10(c)(6).)
