Common use of Basis for Employee Discipline Clause in Contracts

Basis for Employee Discipline. A non-probationary employee may be terminated, suspended or disciplined only for just cause. Disciplinary actions will be consistent with governing laws and regulations and will be taken without regard to race, age, religion, color, national origin, ancestry, sex physical or disability. No employee of the Department will be required to obey any order that is contrary to the laws of the United States, State of New Mexico, or rules of the district however, such refusal to obey is the responsibility of the employee and will be required to justify his action.
