Common use of Basis of Action Clause in Contracts

Basis of Action. A. Upon request, an employee who is the subject of a disciplinary or adverse action as defined in this Article, or the employee’s designated representative, will be furnished a copy of evidence relied upon by the Agency that forms the basis for the notice of disciplinary or adverse action. B. If a proposal or decision letter refers to Article 26 of the National Agreement, the Union may dispute that the disciplinary action is for just and sufficient cause.
