Beneficiary consent. Tenant agrees that (a) the Lease cannot be amended or modified nor have any of its terms waived by the Landlord, (b) Tenant and Landlord may not terminate, cancel or surrender the term of the Lease, except as expressly permitted by the provisions of the Lease, and (c) Tenant shall not pay any rent for more than the month in advance of the date when due, unless in each case Beneficiary’s prior written consent shall have been obtained.

Beneficiary consent. Wherever "beneficiary consent" is required under ------------------- this Agreement, such consent shall be deemed to have been met when a majority in number and two-thirds in dollar amount of the Beneficiaries who vote, vote in favor of the relief requested. For voting purposes, each Beneficiary shall have one vote notwithstanding the number of claims he may have and the dollar amount attributable to such Beneficiary shall be the dollar amount of the Beneficiary's interest in the Trust Estate as of the date of the vote.

Beneficiary consent. Each Beneficiary joins in this Agreement for purposes of acknowledging and giving such Beneficiary's consent to this Agreement and the transactions contemplated hereby. Each party to this Agreement who but for being, and having executed this Agreement as, a Seller would have been a Beneficiary under this Agreement by virtue of being the beneficiary of one or more other Sellers under this Agreement, by his or her execution of this Agreement as a Seller also acknowledges and gives his or her consent to this Agreement in his or her capacity as a beneficiary of such other Seller(s) under this Agreement.

CONTRACTOR SHALL obtain verbal or written consent for the use of telehealth as an acceptable mode of delivering services, Prior to initial delivery of covered services via telehealth, and must explain the following to beneficiaries: 13.6.7.1.1. The beneficiary has a right to access covered services in person. 13.6.7.1.2. Use of telehealth is voluntary and consent for the use of telehealth can be withdrawn at any time without affecting the beneficiary’s ability to access MediCal covered services in the future. 13.6.7.1.3. Non-medical transportation benefits are available for in- person visits. 13.6.7.1.4. Any potential limitations or risks related to receiving covered services through telehealth as compared to an in-person visit, if applicable. 13.6.7.2. CONTRACTOR must also document the beneficiary’s verbal or written consent to receive covered services via telehealth prior to the initial delivery of the services. The beneficiary’s consent must be documented in their medical record and made available to upon request. A provider may utilize a general consent agreement to meet this documentation requirement if that general consent agreement: 13.6.7.2.1. Specifically mentions the use of telehealth delivery of covered services; 13.6.7.2.2. Includes the information described above; 13. 6.7.2.3. Is completed prior to initial delivery of services; 13. 6.7.2.4. Is included in the beneficiary record.
