Common use of Benefit of Contractual Rights Clause in Contracts

Benefit of Contractual Rights. Subject to Section 2.12 of this Agreement, all contractual rights and benefits granted to the holders of Common Stock under the Merger Agreement are hereby granted to the Holder with respect to the Reserved Shares (ignoring for such purposes any restrictions on limitation hereunder).

Benefit of Contractual Rights. Subject to Section 2.12 of this Agreement, all contractual rights and benefits granted to the holders of Common Stock investors under the Merger Purchase Agreement and Warrant are hereby granted to the Holder with respect to the Reserved Shares (ignoring for such purposes any restrictions on limitation hereunder)as if the Holder actually held the Reserved Shares.

Benefit of Contractual Rights. Subject to Section 2.12 of this Agreement, all contractual rights and benefits granted to the holders of Common Stock Holders under the Merger Purchase Agreements and Restructuring Agreement are hereby granted to the each Holder with respect to the Reserved Shares (ignoring for such purposes any restrictions on limitation hereunder)as if the Holder actually held the Reserved Shares.

Benefit of Contractual Rights. Subject to Section 2.12 of this Agreement, all contractual rights and benefits granted to the holders of Common Stock investors under the Merger Purchase Agreement and Warrant are hereby granted to the Holder with respect to the Reserved Shares as if the Holder held the Reserved Shares, including but not limited to Article IV of the Purchase Agreement and (ignoring for such purposes any restrictions on limitation hereunder)without limitation) Sections 4.12, 4.19, 4.21, 4.24, 4.27 and 4.28.
