Common use of Benefit Plans; Vacation Clause in Contracts

Benefit Plans; Vacation. During the Term of Employment, the Executive shall be eligible to participate in, and be covered on the same basis as other senior management of the Company under, all broad-based employee benefit plans and programs maintained from time to time for the benefit of the Company’s employees, subject to the Executive’s satisfaction of the eligibility requirements of such plans or programs and subject to applicable law and the terms and conditions of such plans or programs; provided, however, that the Company may amend, modify and/or terminate any such plans or programs at any time in its discretion.

Benefit Plans; Vacation. During the Term of EmploymentEmployment Term, the Executive shall will be eligible to participate in, and be covered on the same basis as other senior management of in any employee benefit plan adopted by the Company under, all broad-based employee benefit plans and programs maintained from time to time for the benefit of the Company’s its executive employees, subject to satisfying the Executive’s satisfaction applicable eligibility requirements, except to the extent such plans are duplicative of the eligibility requirements benefits otherwise provided under this Agreement. The Executive shall be entitled to the same vacation policy for executive employees of such plans or programs and subject the Company as in effect from time to applicable law and time. Notwithstanding the terms and conditions of such plans or programs; providedforegoing, however, that the Company may amend, modify and/or or terminate any such plans or programs employee benefit plan at any time in its discretiontime.
