Berth Shifting & Vacating Clause Samples
The Berth Shifting & Vacating clause establishes the rights and obligations of a vessel to move from one berth to another or to vacate a berth upon request by port authorities or the terminal operator. In practice, this clause typically requires the vessel to promptly comply with instructions to shift berths or leave a berth, often at the vessel's own expense and risk, unless the movement is for the port's convenience. This provision ensures efficient port operations by allowing terminals to manage berth allocation and vessel traffic, thereby minimizing delays and congestion.
Berth Shifting & Vacating. Owner may require any Vessel to shift from one berth to another at the Terminal at any time. Owner may require any Vessel to vacate its berth if such action is reasonably required for the safe operation of the Terminal. If the Vessel is required to so vacate its berth, the Vessel, after tendering Notice of Readiness to recommence loading or discharging, will be re-berthed in the next open time slot on the Terminal dock schedule. If any Vessel fails to vacate its berth at the Terminal upon completion of loading Customer’s Shipment, then Customer shall be responsible for the costs incurred by other vessels that otherwise would be occupying the Berth but for the failure of Customer’s Vessel to vacate same.
Berth Shifting & Vacating. Magellan may require any Vessel to shift from one berth to another at the Galena Park Terminal. Magellan may require any Vessel to vacate its berth if such action is required, in Magellan's sole discretion, for the safe operation of the Galena Park Terminal. If the Vessel is required to so vacate its berth, the Vessel, after tendering notice of readiness to recommence loading or discharging, will be reberthed in the next open time slot on the Galena Park Terminal dock schedule.
