Beta Releases Sample Clauses

The Beta Releases clause defines the terms under which a party may provide access to software or products that are still in a testing or pre-release phase. Typically, this clause clarifies that beta versions may be incomplete, contain bugs, or lack full functionality, and may be subject to change before final release. It often limits the provider's liability for issues arising from use of the beta product and may restrict how the recipient can use or disclose information about the beta. The core function of this clause is to manage expectations and allocate risk during the testing phase, protecting the provider from claims related to the unfinished nature of the product.
Beta Releases. Docebo at its sole discretion, may invite Customer and make certain services available to the Customer on a test basis which will be clearly designated as beta, pilot, limited release, non-production or by similar description (“Beta Release”). Notwithstanding anything to the contrary in the Agreement, Customer acknowledges and agrees that Beta Release is provided on an “as is” and “as available” basis without any liability and indemnity obligations, warranty, support, Helpdesk Services, Professional Services, maintenance, or service level obligations of any kind. Docebo does not guarantee that future versions of Beta Release will be released or that if such Beta Release is made generally available, it will be substantially similar to the current Beta Release. Docebo may terminate Customer’s right to use Beta Release at any time for any reason. If Docebo publicly releases Beta Release, Customer may execute a separate Order Form to procure the relevant Software Services (being the publicly available version of the Beta Release) at then-current applicable fees.
Beta Releases. We may offer You the right to use certain Beta Releases. If You choose to use Beta Releases, You acknowledge that the Beta Releases are still under development, may be inoperable or incomplete and are likely to contain bugs, errors, omissions and other problems. Beta Releases may be changed at any time without prior notice. Beta Releases are not subject to the DPA (as defined below) and You warrant to have sufficient authority to provide Us with Your Licensee Content for beta testing purposes. We do not guarantee that a Beta Release will be commercially released and made available under these Terms or otherwise. Lansweeper shall not be liable for any damages resulting from your use of the Beta Releases, use at Your own risk. Your use of Beta Release is only permitted for the period designated by Us. We may terminate your right to use Beta Releases at any time and for any reason in our sole discretion, without liability to You. From time to time, You may choose to submit comments, information, questions, data, ideas, description of processes, or other information related to the Beta Releases to Lansweeper, including sharing Your modifications or in the course of receiving support (“Feedback”). Lansweeper may in connection with any of its products or services freely use, copy, disclose, license, distribute and exploit any Feedback in any manner without any obligation, royalty or restriction based on intellectual property rights or otherwise. No Feedback will be considered your Confidential Information, and nothing in these Terms limits Lansweeper’s right to independently use, develop, evaluate, or market products, whether incorporating Feedback or otherwise.‌
Beta Releases. So that RN will remain fully knowledgeable about the ------------- Audible Products, Audible will provide RN with private beta releases of the Audible Products as soon as such releases are available, and with reasonable notice and access to planned product changes.

Beta Releases. The parties acknowledge that this Agreement shall serve as the basis of a strategic technology partnership between Teijin and PMSI, for as long as the JV Company continues to be jointly owned by Teijin and PMSI, whereby Teijin shall receive beta releases from PMSI regarding future products of PMSI at the same time as such releases are made available to other strategic technology partners of PMSI. PMSI agrees to provide such beta releases to Teijin as described in the preceding sentence, and agrees that no end user in Japan shall receive software products from PMSI earlier than the same is received by Teijin (if Teijin so elects to receive such software products).

Beta Releases. 10.1. For the purposes of time-limited evaluation, Provider may provide Customer free of charge and for a limited period of time with access to “beta” or other early-stage versions, integrations, or other features of the Service (the “Beta Releases”). The Beta Releases are optional for Customer to use. Customer may use the Beta Releases only for the period and purposes specified by Provider when they are provided to Customer. Provider is entitled to terminate Customer's use of Beta Releases at any time at its discretion. 10.2. Provider will not provide Customer with Support Services in relation to the Beta Releases. 10.3. The following applies once Customer uses the Beta Releases: a) on each website (each page of the website), which is administered with the use of the Service, the following shall be displayed: (i) Provider’s logo “Powered by Xperience by Kentico” containing a hypertext link to the Provider’s website currently under the following link ▇▇▇▇▇://▇▇▇▇▇▇▇.▇▇▇, the size of which shall be determined by Provider, or (ii) text reading “Powered by Xperience by Kentico” containing a hypertext link to the Provider’s website currently under the following link ▇▇▇▇▇://▇▇▇▇▇▇▇.▇▇▇, the size of which shall be determined by Provider; b) Customer shall not remove any logos or other marks of the Provider from the Service. 10.4. Beta Releases cannot be used for commercial purposes, unless otherwise explicitly agreed between the Parties. Customer is obliged to contact Provider to the email address ▇▇▇▇▇@▇▇▇▇▇▇▇.▇▇▇, once Customer decides to move from the Beta Releases and start using the Service commercially. Customer is obliged, at Provider's request, to regularly make available to Provider the log files relevant for the assessment of the extent of use of the Service by Customer. 10.5. Customer agrees that the Beta Releases are provided on an ‘as is’ and ‘as available’ basis without any warranty, support, maintenance, storage, SLA or indemnity obligations of any kind. Customer acknowledges and agrees that Service provided under the Beta Releases may not be complete or fully functional and may contain bugs, errors, omissions and other problems for which the Provider will not be liable. Accordingly, any use of the Beta Releases is at Customer’s sole liability.

  • Media Releases A. Grantee shall not use System Agency’s name, logo, or other likeness in any press release, marketing material or other announcement without System Agency’s prior written approval. System Agency does not endorse any vendor, commodity, or service. Grantee is not authorized to make or participate in any media releases or public announcements pertaining to this Grant Agreement or the Services to which they relate without System Agency’s prior written consent, and then only in accordance with explicit written instruction from System Agency. B. Grantee may publish, at its sole expense, results of Grantee performance under the Grant Agreement with the System Agency’s prior review and approval, which the System Agency may exercise at its sole discretion. Any publication (written, visual, or sound) will acknowledge the support received from the System Agency and any Federal agency, as appropriate.
