The Billable Services clause defines which services provided by a party are subject to payment under the agreement. Billable Services. Additional charges will be billed to Buyer at Seller’s then prevailing labor rates and Parts prices for any of the following: a) any services not specified in Seller’s quotation, Seller’s order acknowledgement, Seller’s scope of work, or other documents referenced herein and therein; b) any services performed at times other than Seller’s normal service hours; c) if timely and reasonable site and/or equipment access is denied the Seller service representative; d) if it is necessary, due to local circumstances, to use union labor or hire an outside contractor, Seller service personnel will provide supervision only and the cost of such union or contract labor will be charged to Buyer; (e) if service or repair is necessary to return equipment to proper operating condition as a result of other than Seller (i) maintenance, repair, or modification (including, without limitation, changes in specifications or incorporation of attachments or other features), (ii) misuse or neglect, (including, without limitation, failure to maintain facilities and equipment in a reasonable manner), (iii) failure to operate equipment in accordance with applicable specifications, and (iv) catastrophe, accident, or other causes external to equipment; (f) Seller’s performance is made more burdensome or costly as a result of Buyer’s failure to comply with its obligations herein, or (g) any additional obligations or requirements, including but not limited to those related to insurance requirements, service delivery, building entry or technical training.
Billable Services. 31.1 This Article covers situations where an outside organization has requested services of an off-duty Lieutenant and such services are billed to the outside organization.
31.2 Except as provided for in 31.3, Lieutenants covered by this Agreement shall be entitled to compensation for services requested by any outside organization who shall pay for such services. Lieutenants shall also be eligible to perform such services as an Officer/Corporal or Sergeant; however, Lieutenants shall not receive preference for such services. The compensation to perform services for an outside organization by a Lieutenant or a Lieutenant acting as an Officer/Corporal or Sergeant shall be one and one-half (1½ ) times the Lieutenant’s straight time regular hourly rate of pay provided such amount shall not exceed a flat rate of fifty seven dollars ($57.00).
31.3 If an outside organization negotiates a flat rate different from the flat rate in Section 31.2, then the provision set forth in Section 31.3 shall apply. Notice shall be given to the Association of any different flat rate negotiated between the City and the outside organizations requesting services (e.g., University Athletic Association (UAA)) that require a Lieutenant(s) before the rates are finalized. The Lieutenant shall be compensated at the flat rate negotiated between the City and the Outside organization which may exceed fifty dollars ($50.00) but shall not exceed one and one-half (1½ ) times the Lieutenant’s straight time regular hourly rate of pay.
31.4 Hours worked in this Article do not constitute hours worked in this Agreement.
31.5 The compensation in this Article shall be included in gross earnings for pension purposes. This sub-section shall be subject to the pension reopener in this Agreement.
Billable Services. All services performed by Xoft on Customer's Non-Covered Equipment or which are not Covered Services (collectively, "Billable Services") shall be billable to Customer at Xoft's then-current service call fees, including all labor, parts and travel charges.
Billable Services. For On-Call Service certain service calls fall outside the scope of Equipment Maintenance Services and are subject to additional charge at then-current time and material rates. Examples of such calls include but are not limited to: problems caused by hardware, supplies or expendable items not covered under this Agreement; software related calls; calls generated due to operator errors rather than defective hardware; calls due to power surges or lightning damage; and “No-Trouble-Found" calls – problems such as those caused by device cables or phone lines, defective SPS/UPS systems, defective media, defective consumables or other problems which should have been identified in Customer’s call management process. Entrust will make reasonable efforts to provide advance notice to the extent possible before providing service for such calls.
Billable Services. Billable Services shall be performed in accordance with Covaris’ quotation, which shall specify the types of Services to be provided, including without limitation, all specific instruments and equipment requiring the Services.
Billable Services. A. The following “Billable Services” may be performed by Sprint for an additional charge upon Customer’s request:
(1) Troubleshooting Software or hardware issues caused by products, provided by parties other than Sprint, that are attached to or otherwise integrated into the Equipment and are not otherwise covered by this Agreement, including resolving voice over data issues resulting from variation of network traffic patterns following initial installation or the addition of non-Sprint approved voice over data design equipment by Customer to its network;
(2) Performing Customer-requested Software changes such as scripting or other customized application development;
(3) Performing Customer-specified hardware changes, including, but not limited to adding or removing accessories, attachments or other devices, or moving or relocating the Equipment;
(4) Installing any hardware upgrade, Maintenance Release, or Software Major Release, including any hardware upgrade required to run upgraded Software;
(5) Repairing or replacing malfunctioning hardware components and software releases. Hardware components and software releases are available for purchase from Sprint under a separate agreement and deliverable by drop ship to a Customer-specified location. Prices will be quoted at time of ordering.
(6) Installing replacement hardware components or software releases.
(7) Dispatches to Customer's site for incomplete service calls through no fault of Sprint including, but not limited to, Customer’s failure to provide access to the Sprint representative. Customer will be charged a Service Charge plus one (1) hour labor at Sprint's then-current Centurion labor rates;
(8) Performing other services except as provided in this Agreement; or
(9) Changes to the configuration of the covered Equipment that provide new functionality, usability or appearance to the Equipment.
Billable Services. All services performed by Affymetrix on Customer’s Non-Covered Equipment or which are not Covered Services (collectively, “Billable Services”) shall be billable to Customer at Affymetrix’ then-current service call fees, including all labor, parts and zone charges.
Billable Services. 3 34.1 This Article covers situations where an outside organization has requested 4 services of an off-duty Officer, Corporal, or Sergeant. Such services are billed to 5 the outside organization.
6 34.2 Officers, Corporals, and Sergeants covered by this Agreement shall be entitled to 7 compensation for services requested by any outside organization who shall pay 8 for such services.
9 A. A Sergeant shall also be eligible to perform such services as an Officer or 10 Corporal; however, a Sergeant shall not receive preference for such 11 services.
12 B. Unless a separate rate is negotiated in accordance with 34.3 below, and 13 except as provided herein, employees performing services for an outside 14 organization shall be compensated at one and one-half (1½) times his/her 15 respective straight time hourly rate of pay. The compensation to perform 16 services for an outside organization by a Sergeant acting as an 17 Officer/Corporal shall be one and one-half (1½) times the Sergeant’s 18 straight time hourly rate of pay, provided such amount shall not exceed a 19 flat rate of fifty six dollars fifty cents ($56.50). 20 Either party may reopen this section (34.2.B.) one time during the term of 21 this Agreement, upon written notice to the other party.
22 34.3 In contracting for billable services for special large scale events, the City may 23 agree to a rate different than that provided in paragraph 34.2.B. This option shall 24 apply to the University Athletic Association (UAA), Gator Nationals, or ESPN, 25 without notice to the FOP; or other similar vendors upon notice to the FOP.
26 34.4 Hours worked under this Article do not count as hours worked for the purpose of 27 computing overtime in Article 14.
Billable Services sole discretion, may terminate the Agreement if Customer fails to make required upgrades by the CenturyLink-required deadlines. The following Billable Services may be performed by CenturyLink for an additional charge upon Customer’s request:
(1) Performing Customer-specified moves, adds, and changes to Equipment, including, but not limited to adding or removing accessories, attachments or other devices, or moving or relocating the Equipment (with all purchases under this section subject to the Equipment Sales Product Annex);
(2) Troubleshooting Software or hardware issues caused by products, provided by parties other than CenturyLink, that are attached to or otherwise integrated into the Equipment and are not otherwise covered by this Agreement, including resolving voice over data issues resulting from variation of network traffic patterns following initial installation or the addition of non-CenturyLink approved voice over data design equipment by Customer to its network;
(3) Performing Customer-requested Software changes such as scripting or other customized application development;
(4) Installing any hardware upgrade or Software Major Release, including any hardware upgrade required to run upgraded Software;
(5) Repairing or replacing parts or materials associated with Equipment and consumed in the ordinary course of business;
(6) Repairing or replacing parts, materials, or software lost, stolen, or damaged through circumstances outside CenturyLink’s control, including but not limited to accident, negligence, abuse, misuse, and failure of electrical power, air conditioning or humidity control, riot or other civil disturbance, strike or other labor trouble, sabotage, fire, flood, lightning or electrical storms, or other act of God, Customer or persons other than CenturyLink or its authorized contractors;
(7) Dispatches to Customer's site for incomplete service calls through no fault of CenturyLink including, but not limited to, Customer’s failure to provide access to the CenturyLink representative. Customer will be charged a Service Charge plus one hour of labor at CenturyLink's then-current Centurion labor rates;
(8) Performing other maintenance except as provided in this Agreement; or
(9) Changes to the configuration of the covered Equipment that provide new functionality, usability or appearance to the Equipment.
