Common use of Billing and Collection Customers Clause in Contracts

Billing and Collection Customers. XxxxXxxxx currently has in effect numerous billing and collection agreements with various interexchange carriers and billing clearing houses and as such these billing and collection customers (“B&C Customers”) query BellSouth’s LIDB to determine whether to accept various billing options from End Users. Until such time as BellSouth implements in its LIDB and its supporting systems the means to differentiate Conextel’s data from BellSouth’s data, the following shall apply: (1) BellSouth will identify Conextel end user originated long distance charges and will return those charges to the interexchange carrer as not covered by the existing B&C agreement. Conextel is responsible for entering into the appropriate agreement with interexchange carriers for handling of long distance charges by their end users. (2) BellSouth shall have no obligation to become involved in any disputes between Conextel and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to Conextel. It shall be the responsibility of Conextel and the B&C Customers to negotiate and arrange for any appropriate adjustments.

Conextel Knology is responsible for entering into the appropriate agreement with interexchange carriers for handling of long distance charges by their end users. (2) BellSouth shall have no obligation to become involved in any disputes between Conextel Knology and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelKnology. It shall be the responsibility of Conextel Knology and the B&C Customers to negotiate and arrange for any appropriate adjustments.

(2) BellSouth shall have no obligation to become involved in any disputes between Conextel Direct Telephone and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelDirect Telephone. It shall be the responsibility of Conextel Direct Telephone and the B&C Customers to negotiate and arrange for any appropriate adjustments.

(2) BellSouth shall have no obligation to become involved in any disputes between Conextel Azul Tel and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelAzul Tel. (2) BellSouth shall have no obligation to become involved in any disputes between Conextel Telstar Prepaid and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelTelstar Prepaid. It shall be the responsibility of Conextel Telstar Prepaid and the B&C Customers to negotiate and arrange for any appropriate adjustments.

(2) BellSouth shall have no obligation to become involved in any disputes between Conextel The Phone Connection and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelThe Phone Connection. It shall be the responsibility of Conextel The Phone Connection and the B&C Customers to negotiate and arrange for any appropriate adjustments.

Conextel E-Z Access is responsible for entering into the appropriate agreement with interexchange carriers for handling of long distance charges by their end users. (2) . BellSouth shall have no obligation to become involved in any disputes between Conextel E-Z Access and B&C Customers. XxxxXxxxx BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelE-Z Access. It shall be the responsibility of Conextel E-Z Access and the B&C Customers to negotiate and arrange for any appropriate adjustments.

Conextel International Telnet is responsible for entering into the appropriate agreement with interexchange carriers for handling of long distance charges by their end users. (2) BellSouth shall have no obligation to become involved in any disputes between Conextel International Telnet and B&C Customers. XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to ConextelInternational Telnet. It shall be the responsibility of Conextel International Telnet and the B&C Customers to negotiate and arrange for any appropriate adjustments.
