Common use of Billing and Collection Customers Clause in Contracts

Billing and Collection Customers. BellSouth currently has in effect numerous billing and collection agreements with various interexchange carriers and billing clearing houses and as such these billing and collection customers (“B&C Customers”) query BellSouth’s LIDB to determine whether to accept various billing options from End Users. Until such time as BellSouth implements in its LIDB and its supporting systems the means to differentiate A-Tech Telecom’s data from BellSouth’s data, the following shall apply: (1) A-Tech Telecom will accept responsibility for telecommunications services billed by BellSouth for its B&C Customers for A-Tech Telecom’s End User accounts which are resident in LIDB pursuant to this Agreement. A-Tech Telecom authorizes BellSouth to place such charges on A-Tech Telecom’s xxxx from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom collects from A-Tech Telecom’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech Telecom. It shall be the responsibility of A-Tech Telecom and the B&C Customers to negotiate and arrange for any appropriate adjustments.

A-Tech Telecom Universal Telecom, Inc authorizes BellSouth to place such charges on A-Tech Universal Telecom, Inc’s xxxx bill from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom Universal Telecom, Inc shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom Universal Telecom, Inc shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom Universal Telecom, Inc collects from A-Tech Universal Telecom, Inc’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Universal Telecom, Inc and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech Universal Telecom. , Inc. It shall be the responsibility of A-Tech Telecom Universal Telecom, Inc and the B&C Customers to negotiate and arrange for any appropriate adjustments.

(2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) Ae-Tech Telecom Tel shall have the responsibility to render a billing statement to its End Users for these charges, but Ae-Tech Telecom Tel shall pay BellSouth for the charges billed regardless of whether Ae-Tech Telecom Tel collects from Ae-Tech TelecomTel’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom e-Tel and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to Ae-Tech TelecomTel. It shall be the responsibility of Ae-Tech Telecom Tel and the B&C Customers to negotiate and arrange for any appropriate adjustments.

(2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom Source One Communications shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom Source One Communications shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom Source One Communications collects from A-Tech TelecomSource One Communications’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Source One Communications and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech TelecomSource One Communications. It shall be the responsibility of A-Tech Telecom Source One Communications and the B&C Customers to negotiate and arrange for any appropriate adjustments.

A-Tech Telecom AllSouth Phone Connect authorizes BellSouth to place such charges on A-Tech TelecomAllSouth Phone Connect’s xxxx from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom AllSouth Phone Connect shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom AllSouth Phone Connect shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom AllSouth Phone Connect collects from A-Tech TelecomAllSouth Phone Connect’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom AllSouth Phone Connect and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech TelecomAllSouth Phone Connect. It shall be the responsibility of A-Tech Telecom AllSouth Phone Connect and the B&C Customers to negotiate and arrange for any appropriate adjustments.

A-Tech Telecom Down Home Telephone authorizes BellSouth to place such charges on A-Tech TelecomDown Home Telephone’s xxxx from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom Down Home Telephone shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom Down Home Telephone shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom Down Home Telephone collects from A-Tech TelecomDown Home Telephone’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Down Home Telephone and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech TelecomDown Home Telephone. It shall be the responsibility of A-Tech Telecom Down Home Telephone and the B&C Customers to negotiate and arrange for any appropriate adjustments.

A-Tech Telecom Your Communication Connection authorizes BellSouth to place such charges on A-Tech TelecomYour Communication Connection’s xxxx from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom Your Communication Connection shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom Your Communication Connection shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom Your Communication Connection collects from A-Tech TelecomYour Communication Connection’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Your Communication Connection and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech TelecomYour Communication Connection. It shall be the responsibility of A-Tech Telecom Your Communication Connection and the B&C Customers to negotiate and arrange for any appropriate adjustments.

Rent-A-Tech Telecom Line authorizes BellSouth to place such charges on Rent-A-Tech TelecomLine’s xxxx from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) Rent-A-Tech Telecom Line shall have the responsibility to render a billing statement to its End Users for these charges, but Rent-A-Tech Telecom Line shall pay BellSouth for the charges billed regardless of whether Rent-A-Tech Telecom Line collects from Rent-A-Tech TelecomLine’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Rent- A-Line and B&C Customers. BellSouth will not issue adjustments for charges billed on behalf of any B&C Customer to Rent-A-Tech TelecomLine. It shall be the responsibility of Rent- A-Tech Telecom Line and the B&C Customers to negotiate and arrange for any appropriate adjustments.

A-Tech Telecom Source One Communications authorizes BellSouth to place such charges on A-Tech TelecomSource One Communications’s xxxx bill from BellSouth and shall pay all such charges, including, but are not limited to, collect and third number calls. (2) Charges for such services shall appear on a separate BellSouth xxxx xxxx identified with the name of the B&C Customers for which BellSouth is billing the charge. (3) A-Tech Telecom Source One Communications shall have the responsibility to render a billing statement to its End Users for these charges, but A-Tech Telecom Source One Communications shall pay BellSouth for the charges billed regardless of whether A-Tech Telecom Source One Communications collects from A-Tech TelecomSource One Communications’s End Users. (4) BellSouth shall have no obligation to become involved in any disputes between A- Tech Telecom Source One Communications and B&C Customers. BellSouth XxxxXxxxx will not issue adjustments for charges billed on behalf of any B&C Customer to A-Tech TelecomSource One Communications. It shall be the responsibility of A-Tech Telecom Source One Communications and the B&C Customers to negotiate and arrange for any appropriate adjustments.
