Common use of Billing Limitations Clause in Contracts

Billing Limitations. The Department shall not pay any claims for payment for Services submitted more than 12 months after the calendar month in which the Services were performed unless such failure to submit the claim to the Department by Contractor is due to the fault of the Department, nor shall the Department pay for Services performed under this Contract if Contractor has charged or will charge the state of Montana or any other party for the same Services.
