Common use of Binding Effect; Amendment Clause in Contracts

Binding Effect; Amendment. This Agreement shall be binding upon and inure to the benefit of the parties and their respective successors and assigns, subject, however, to the provisions of the Credit Agreement. No provision of this Agreement may be amended, waived or otherwise modified except by an instrument in writing signed by each party hereto and by the Administrative Agent.

Binding Effect; Amendment. This Agreement contains the entire agreement of the parties, and shall be binding upon and inure to the benefit of and be binding upon the parties hereto and upon their respective successors in interest of any kind whatsoever, including, but not limited to, their assignees, administrators, trustees, attorneys-in-fact and assignslegal representatives (except as herein otherwise provided). Except as expressly supplemented hereby, the Security Agreement, Credit Agreement and Depositary Agreement shall remain in full force and effect.
