Common use of Biosimilar Products Clause in Contracts

Biosimilar Products. On a country-by-country and Licensed Product-by-Licensed Product basis: (a) upon the first commercial sale of one or more Biosimilar Products with respect to a Licensed Product in any country in the Territory during the Royalty Term, the Royalty rates provided in Section 9.4.2 above for the Licensed Product will be reduced in such country by [***] from the date of first commercial sale of such Biosimilar Product(s) in such country; and (b) [***].

Biosimilar Products. Biosimilar Products. On a country-by-country and Licensed Product-by-Licensed Product basis: (a) , upon the first commercial sale of one or more Biosimilar Products with respect to a Licensed Product in any country in the Territory during the Royalty Term, the Royalty royalty rates provided in pursuant to Section 9.4.2 above for the Licensed 3.4 with respect to sales of such Product will be permanently reduced in such country by [***] (in addition to any reductions in Section 3.8) from the date of first commercial sale of such Biosimilar Product(s) in such country; and (b) [***].
