Bonus for early completion. In the event that the Project Completion Date occurs prior to the Scheduled Completion Date, the Contractor shall be entitled to receive a payment of bonus equivalent to 0.03% (zero point zero three per cent) of the Contract Price for each day by which the Project Completion Date precedes the Scheduled Completion Date, but subject to a maximum of 5% (five per cent) of the Contract Price. Provided, however, that the payment of bonus, if any, shall be made only after the issue of the Completion Certificate. For the avoidance of the doubt, the Parties agree that for the purpose of determining the bonus payable hereunder, the works shall always be deemed to be as specified in this Contract Agreement but excluding the works deemed to be deleted from the scope of work under clause 8.3 of this Contract Agreement and the Contract Price shall always be deemed to be the amount specified in Clause 19.1 (i) after excluding the Contract Price of the Works deemed to be deleted from the Scope of Work under clause 8.3 of this Contract Agreement, and shall exclude any revision thereof for any reason. The Parties also agree that bonus shall be payable only if each work for which Time Extension has been granted is completed within respective Extended Time.

(*) Partial earlier completion may not always produce net benefits to the Employer, for example where utilization of the completed Works requires (a) the fulfillment of all parts of the Contract (e.g. the training of personnel); or (b) the completion of all Sections (e.g. in pipeline laying, where early completion of the laying of pipeline would not be useful if the compressor is still under installation); or (c) certain seasonal effects to take place (e.g. onset of the rainy season, for impounding a reservoir); or (d) other circumstances. Also a more rapid drawdown of budgeted funds may be required. All such factors should be considered prior to the inclusion of a bonus clause in the Contract.

(iii) In the event that a COMPLETION BONUS is paid to CONTRACTOR pursuant to this Section 6.5, then the SUBSTANTIAL COMPLETION DEADLINE shall be moved forward one day for each BONUS ELIGIBLE DAY (so that, for example, if there are 5 BONUS ELIGIBLE DAYS, the SUBSTANTIAL COMPLETION DEADLINE shall be 22 months and 2 days from the date of the CONTRACT). (iv) In order to induce NATIONAL to enter into this AMENDMENT, CONTRACTOR hereby affirms and agrees that it shall not, in an effort to expedite the HOT RUN COMMENCEMENT, (i) reduce the time period allotted for the No Load Test or Cold Run Test in the No. 1 CGL Overall Schedule, as set forth in the AS SOLD SPECIFICATIONS, or (ii) otherwise modify, amend or depart from the SPECIFICATIONS in its performance of the WORK, without in either case, the prior written consent of NATIONAL. Bonus for early completion. In the event that Commercial Operation occurs prior to the Guaranteed Commercial Operation Date, the Contractor shall be compensated Twelve Thousand and Five Hundred Dollars ($12,500) per day for every day between August 15, 1998 and August 31, 1998 that Commercial Operation is achieved.
