Common use of Borrowers Not Beneficiary Clause in Contracts

Borrowers Not Beneficiary. Except for the provisions of §14.9 relating to the appointment of a successor Agent, the provisions of this §14 are solely for the benefit of the Agent and the Lenders, may not be enforced by the Borrowers, and except for the provisions of §14.9, may be modified or waived without the approval or consent of the Borrowers.

Borrowers Not Beneficiary. Except for the provisions of §14.9 relating to the appointment of a successor Agent, the provisions of this §14 are solely for the benefit of the Agent and the LendersBanks, may not be enforced by Borrowers or the BorrowersGuarantor, and except for the provisions of §14.9, may be modified or waived without the approval or consent of Borrowers or the BorrowersGuarantor.
