Common use of Borrowing Request, etc Clause in Contracts

Borrowing Request, etc. The Administrative Agent shall have received, as herein provided, a duly completed and executed Borrowing Request, or in, accordance with the provisions of Section 2.1.2, a notice requesting the issuance of a Letter of Credit. Each delivery of a Borrowing Request and each notice requesting the issuance of a Letter of Credit shall constitute a representation and warranty by the Borrower that on the date of such Borrowing or issuance of a Letter of Credit (both immediately before and after giving Pro Forma Effect to such Borrowing or issuance of a Letter of Credit and the application of the proceeds thereof) the statements made in Section 5.3.1 are true and correct.
