Breach of the Agreement. 13.1 Should the Resident breach this Agreement due to breaching a Zero Tolerance Rule as set out in Annexure D: Community Guidelines: 13.1.1 CampusKey shall be entitled to cancel this Agreement immediately and impose a reasonable cancellation penalty on the Resident, as set out in Annexure C: Cancellation Policy; 13.1.2 the Resident will remain liable to CampusKey for any amounts owed in terms of this Agreement, up to date of cancellation; and 13.1.3 no notice period will be applicable for this breach as the breach is severe. 13.2 Should the Resident breach this Agreement due to breaching any of the Community Guidelines 3 (three) times during Your Stay: 13.2.1 CampusKey shall be entitled, but not obliged, to cancel this Agreement immediately and impose a reasonable cancellation penalty on the Resident, as set out in Annexure C: Cancellation Policy; 3.2.2 the Resident will remain liable to CampusKey for any amounts owed in terms of this Agreement, up to date of cancellation; and 13.2.3 no notice period will be applicable for this breach, as the three-step fine system offers the Resident more than 20 Business Days’ notice of the approaching breach. 13.3 Should the Resident breach this Agreement due to failing to pay the Service and Residence Fee timeously in terms of this Agreement and fail to remedy that breach within a period of 20 Business Days after receipt of a written notice to that effect from CampusKey: 13.3.1 CampusKey shall be entitled, but not obliged, to cancel this Agreement and impose a reasonable cancellation penalty on the Resident, as set out in Annexure C: Cancellation Policy; 3.3.2 the Resident will remain liable to CampusKey for any amounts owed in terms of this Agreement, up to date of cancellation; and 13.3.3 CampusKey will issue a written notice to the Resident 20 Business Days prior to cancelling the Agreement. 13.4 Should either of the Parties: 13.4.1 commit any breach of any other condition of this Agreement, save for a breach as set out in clause 13.1, 13.2 and 13.3, and fail to remedy that breach within a period of 20 Business Days after receipt of a written notice to that effect to it by the other Party; or 13.4.2 commit any act of insolvency; then the other Party shall be entitled to: 13.4.2.1 cancel this Agreement; or 13.4.2.2 remedy such breach and immediately recover the total cost it has incurred in so doing from the other Party. 13.5 While the Resident is in occupation of the Room and irrespective of any dispute between the Parties, then: 13.5.1 the Resident shall continue to pay all amounts due to CampusKey in terms of this Agreement on the due dates of the same; 13.5.2 CampusKey shall be entitled to recover and accept those payments; and 13.5.3 the acceptance by CampusKey of those payments shall be without prejudice to and shall not in booking is 18 years. Resident’s younger than the age of 18 need permission of their parents or legal representatives to make a booking at CampusKey. 17.2 If the person signing this electronic Agreement, as reflected on the Student Portal, is not the Resident of the Room, then the person signing this Agreement accepts his/her liability jointly and severally with the Resident as surety and co-principal debtor for amounts which may become due to CampusKey by the Resident at any time in terms of this Agreement. any manner whatsoever affect CampusKey’s claim to cancellation of this Agreement or for damages of any other nature whatsoever.

Breach of the Agreement. 13.1 Should If the Resident Tenant fails to pay the Rent, Service Charge or other Fees including but not limited to water fees, electricity fees in accordance with this Agreement, the Tenant shall pay a penalty of 0.05% of the total amount of due payment each day from the date of due dates to the date that the Tenant clears all the due payment. If such delay of payment exceeds thirty days, it shall be considered the Tenant’s breach of the Agreement and the Landlord shall be entitled to claim the Tenant’s responsibility pursuant to Clause 13.2. 13.2 The following situation will be considered severe violation of the Agreement by Tenant, the Landlord shall be entitled to terminate the Agreement. The lease termination date shall be the date when the Landlord’s written notice is received by the Tenant: 13.2.1 the full amount of Rent, Service Charge or other Fees hasn’t been paid for over thirty (30) days; 13.2.2 breach of this Agreement (including the Clauses in this Agreement and the regulation established by the Landlord) and fails to remedy after thirty (30) days of written notice issued by the Landlord; 13.2.3 the Tenant faces financial crisis, reckoning, or revoke of Business License; 13.2.4 any Tenant ‘s property in the premises is sealed up or kept in custody; 13.2.5 the Tenant sub-let or let the premises without permission; 13.2.6 the Tenant does not use the premises in accordance with agreed purpose, or conduct illegal activities in the premises; or 13.2.7 the Tenant terminates the Lease early without grounds in law or in this Agreement. 13.2.8 other circumstance in this Agreement defined as severe violation of the Agreement. 13.3 The Tenant hereby explicitly agrees and declares, where the Landlord terminates this Agreement due to breaching a Zero Tolerance Rule as set out in Annexure D: Community Guidelines: 13.1.1 CampusKey Tenant’s above breaches or other breaches according to the law where the Landlord is entitled to terminate this Agreement, the Landlord shall be entitled to cancel this Agreement immediately forfeit all Security Deposit and impose a reasonable cancellation penalty on take back the Residentpremises. In addition to the liability of paying off all due payment, as set out in Annexure C: Cancellation Policy;the Tenant shall bear all the following liabilities: 13.1.2 13.3.1 paying liquidated damages which equal to sum total of six months’ rents (the Resident will remain liable to CampusKey for any amounts owed in terms standard of such rent shall be the rent at the time of termination of this Agreement, up to date of cancellation; and) (including the Security Deposit placed by the Tenant); 13.1.3 no notice period will be applicable for this breach as the breach is severe. 13.2 Should the Resident breach this Agreement due to breaching any 13.3.2 paying liquidated damages at 0.05% of the Community Guidelines 3 (three) times during Your Stay: 13.2.1 CampusKey shall be entitled, but not obliged, to cancel this Agreement immediately and impose a reasonable cancellation penalty on the Resident, as set out in Annexure C: Cancellation Policytotal amount of due payment each day; 3.2.2 13.3.3 compensating the Resident will remain liable to CampusKey for any amounts owed in terms of this Agreement, up to date of cancellation; and 13.2.3 no notice period will be applicable for this breach, as the three-step fine system offers the Resident more than 20 Business Days’ notice rest of the approaching breach. 13.3 Should losses if the Resident breach this Agreement due to failing to pay the Service and Residence Fee timeously in terms of this Agreement and fail to remedy that breach within a period of 20 Business Days after receipt of a written notice to that effect from CampusKey: 13.3.1 CampusKey shall be entitled, but above liquidated damages cannot obliged, to cancel this Agreement and impose a reasonable cancellation penalty on the Resident, as set out in Annexure C: Cancellation Policy; 3.3.2 the Resident will remain liable to CampusKey make up for any amounts owed in terms of this Agreement, up to date of cancellation; and 13.3.3 CampusKey will issue a written notice to the Resident 20 Business Days prior to cancelling the Agreementall losses. 13.4 Should either Since the Rent, Service Charge and other Fees on water and electricity at the expense of Party B are necessary in managing and running the Parties: 13.4.1 commit building, the Landlord holds the right to cut off all these supplies until the Tenant pays them off in the case of delayed payment. And any breach of any other condition of economic losses due to this Agreement, save for a breach as set out in clause 13.1, 13.2 and 13.3, and fail to remedy that breach within a period of 20 Business Days after receipt of a written notice to that effect to it shall be borne by the other PartyTenant; or 13.4.2 commit any act of insolvency; then and the other Party expenses on restoring these supplies shall be entitled to: 13.4.2.1 cancel this Agreement; or 13.4.2.2 remedy such breach and immediately recover the total cost it has incurred in so doing from the other PartyTenant’s responsibility. 13.5 While the Resident is in occupation of the Room and irrespective of any dispute between the PartiesAny behavior, then: 13.5.1 the Resident shall continue to pay all amounts due to CampusKey in terms of negligence, non-performance or violation against this Agreement on from the due dates of employees, agents, contractors, invitees, customers or visitors from the same; 13.5.2 CampusKey Tenant shall be entitled to recover regarded as behavior, negligence, non-performance, or violation against this Agreement from the Tenant and accept those payments; and 13.5.3 the acceptance by CampusKey of those payments Tenant shall be without prejudice to and shall not in booking is 18 years.
