Bring Down of Certain Representations and Warranties. Generex hereby restates, as if first made as of and on the date of this Amendment, the representations and warranties set forth in the Purchase Agreement (as modified by the Disclosure Schedules to the extent they apply thereto) in Sections 3.1(a), (b), (g), (h), (i), (j), (k), (l), (m), (n), (o), (p), (q), (r), (u), (v), (x), (aa), (cc), (ee), and (hh); provided that (1) the term “Transaction Documents” therein shall refer not only to such term as defined in the Purchase Agreement but also to the Transaction Documents defined in this Amendment, and (2) the term the “Company” defined in such Purchase Agreement shall also refer to “Generex” as used herein.
