Common use of BUY AMERICA PROVISION Clause in Contracts

BUY AMERICA PROVISION. (a) The Contractor agrees to comply with 49 U.S.C. 5323(j) and the FTA’s implementing regulations found at 49 C.F.R. Part 661, which require that all steel, iron, and manufactured products used in FTA-funded projects are pro- duced in the United States, unless FTA has granted a waiver or the product is subject to a general waiver. The provisions of that Act and its implementing regulations are hereby incorporated by reference into this Contract. The Contractor shall comply with the Buy America certification(s) submitted with its proposal/bid.
