Common use of Buyer Delays Clause in Contracts

Buyer Delays. In the event that: (i) the delivery of and payment of the Final Contract Price for the Aircraft is delayed more than five (5) days after the firm delivery date established pursuant to Subclause 9.1 due to any breach of the Buyer under this Agreement, or (ii) within two (2) days after delivery of and transfer of title to the Aircraft the Buyer has failed to remove such Aircraft for whatever reason (except for reasons attributable to the Seller or the Manufacturer), then the Buyer will on demand reimburse the Seller for all reasonable out-of-pocket costs and expenses sustained by the Seller and resulting from any such delay or failure. Such reimbursement will be in addition to any other rights that the Seller may have under this Agreement as a result of any such delay or failure.
