Calorific Adjustment. Such weighted average calorific value shall be used in adjusting the price of coal in the following manner. The F.O.B. Railcar Price then in effect, specified and determined as provided in Section V, but before any Ash or S02 Adjustment provided for hereafter in this Section VI, shall be adjusted to reflect variation from 12,000 BTU per pound in such weighted average calorific value of the coal received, in arriving at the price (exclusive of any Ash or SO2 Adjustment) to be paid by KU to Seller for such coal, in accordance with the following formula (assuming, for purposes of illustration, an adjusted price, prior to the Calorific Adjustment, of $20.55): ACTUAL BTU/LB. - 12,000 x $20.55 = Premium/Penalty Per Ton ----------------------- 12,000

Calorific Adjustment. The price per ton of coal shall be increased or decreased to compensate for variations in the calorific value of the coal shipped. The BTU content shall be determined on actual “as received” basis. If the actual average heating value of the coal shipped by Seller on each shipment is one hundred (100) BTU per pound, or more, in excess or fifty (50) BTU per pound, or more, below the Guaranteed Specification, the base price per ton will be adjusted in accordance with the following formula: Base Price $32 and 11,650 Guaranteed as stated in this Agreement 11,750 Btu/lb/11,650 Btu/lb=1.008584 x $32 ton=$32.27 11,600 Btu/lb/11,650 Btu/lb=.995708 x $32 ton=$31.86 The price per ton of coal shall be decreased if the monthly weighted average percent of ash is greater than the ash guarantee as set forth in the Seller’s coal specifications. The price per ton reduction shall be $0.30 per ton for each percent, fractions pro rata, by which the weighted average of the “as received” ash content for the coal delivered that month exceeds the guaranteed level. No credits will be given if the “as received” ash content is less than the guaranteed level. The ash penalty adjustment shall be made in accordance with the following formula:

  • Cost Adjustments Both parties agree that contracted prices shall be fixed for the first 12 months of this Contract. Contractor must submit to District any proposed cost adjustments at least 60 days before the proposed effective date of such increases with a detailed explanation for each adjustment. District alone reserves the right to reject any changes to this Contract it deems unacceptable.

  • Market Adjustment The parties to this Agreement recognize the appropriateness of market pay adjustments in rare instances for compelling reasons. To effectuate judgments in such cases, the President and AAUP Chapter President, in consultation, shall each name three (3) individuals to a university Market Evaluation Committee. Deans may submit recommendations for market pay adjustments with supporting written reasons to the Committee. Said Committee shall consult with the President concerning proposed market pay adjustments reporting its advice not later than May 15 in each year. Upon the favorable recommendation of the President and the BOR President, market pay adjustments may be approved effective at the beginning of that pay period including September 1 of the following year. Not more than one (1) market pay adjustment per one hundred (100) full-time members, or fraction thereof, may be recommended in any contract year. A member’s salary may not be increased beyond the maximum for the rank. Funding for this program shall be governed by Article 12.10.2.

  • CPI Adjustment If the CPI Percentage Increase (as defined below) is more than [***] for the relevant Adjustment Period, then the Rent payable during that Adjustment Period shall be adjusted upward by a percentage equal to the CPI Percentage Increase (as defined below) applicable to such Adjustment Period, but not to exceed an adjustment during any Adjustment Period of greater than [***]. If the Landlord disagrees with the Tenant’s calculation of the CPI Percentage Increase, then the Landlord shall deliver to the Tenant written notice, describing the basis for such disagreement in reasonable detail (a “CPI Disagreement Notice”), not later than thirty (30) days after delivery of the CPI Notice. If the Landlord fails to deliver a CPI Disagreement Notice within thirty (30) days after delivery of any CPI Notice, then the Landlord shall be conclusively deemed to have agreed with the calculation of the CPI Percentage Increase set forth in such CPI Notice.

  • Market Adjustments Neither this Article nor any other in this Collective Agreement prevents the Employer from using other funds to increase a Member’s salary in response to offers received from other employers or to accommodate other market forces.

  • ECONOMIC ADJUSTMENT Exhibit B – Prices for Goods/Services is hereby amended by deleting the existing Exhibit B in its entirety and inserting the attached Exhibit B – Prices for Services to increase by 5.1% from the previous set price.
