Common use of Canadian Administrative Agent Clause in Contracts

Canadian Administrative Agent. Each of the Lenders hereby agrees and confirms that the provisions of this Section 12 shall apply mutatis mutandis to the Canadian Administrative Agent as if each reference to the Administrative Agent were a reference to the Canadian Administrative Agent unless the context clearly indicates otherwise upon the same terms and subject to the same conditions as provided in this Section 12; provided, that any successor Canadian Administrative Agent shall be a bank having a combined capital and surplus of at least $500,000,000 or be an Affiliate of any such bank which is also a bank.
