Common use of Cancellation of Payment Orders Clause in Contracts

Cancellation of Payment Orders. Customer may cancel a payment order but Bank shall have no liability for Bank’s failure to act on a cancellation instruction unless Bank has received such cancellation instruction at a time and in a manner affording Bank reasonable opportunity to act prior to Bank’s execution of the order. Any cancellation shall be sent and confirmed in the manner set forth in Paragraph 2 above.

However, Bank shall make a reasonable effort to act on Customer’s request for cancellation or amendment of a payment order prior to the time that the Bank executes such payment order, but Bank shall have no liability for Bank’s failure to act on a cancellation instruction unless Bank has received if such cancellation instruction at a time and in a manner affording Bank reasonable opportunity to act prior to Bank’s execution of the order. Any cancellation shall be sent and confirmed in the manner set forth in Paragraph 2 aboveor amendment is not affected.
