Cancellation of Services. (a) ARTC will request the HVCCC to inform ARTC on a weekly basis of the total number of cancelled services assigned to the Access Holder in the previous week by the Live Run Superintendent Group, as collated and reported by the HVCCC, and whether the total number of cancellations assigned to the Access Holder in that week has had, in the reasonable opinion of the HVCCC, an impact on Capacity, Coal Chain Capacity or the Capacity entitlement of another access holder in that week.
(b) To avoid doubt, the number of cancelled services assigned to the Access Holder, as collated and reported by the HVCCC, may include cancellations of services scheduled to be used or operated by or on behalf of another access holder where the cancellation was assigned to the Access Holder by the Live Run Superintendent Group.
(c) If ARTC is informed by the HVCCC that the cancellations in clause 11.6(a) have had, in the reasonable opinion of the HVCCC, an impact on Capacity, Coal Chain Capacity or the Capacity entitlement of another access holder, then ARTC may remove Path Usages from the Access Holder’s Base Path Usages in the Period immediately following the Period in which the cancellations had an impact on Capacity, Coal Chain Capacity, or the contractual entitlement of another access holder.
(d) If Base Path Usages are removed in accordance with this clause 11.6(c), ARTC will delete the number of removed Path Usages from the Access Holder’s Annual Contracted Path Usages in the relevant Train Path Schedule by notice to the Access Holder. To avoid doubt, a cancellation or a reduction of Path Usages made available to the Access Holder as a result of a Capacity Shortfall under clause 6 will not constitute a cancellation under this clause 11.6.
(e) The number of Path Usages to be removed from the Access Holder under
(i) in respect of the number of cancellations assigned to the Access Holder due to a single event be no more than two; and
(ii) in total will be no more than the number of cancellations reported in clause 11.6.
(f) If ARTC is informed by the HVCCC that the cancellations reported in this clause 11.6 have had, in the reasonable opinion of the HVCCC, an impact on Capacity, Coal Chain Capacity or the Capacity entitlement of another access holder, but ARTC has not removed Base Path Usages from the Access Holder, then ARTC will provide written reasons for its decision not to remove Base Path Usages from the Access Holder to:
(i) the HVCCC; or
(ii) if requested, the Access Hol...
Cancellation of Services. Section 22 of the Original Agreement is hereby suspended during the Amendment Period only with respect to the Base Payment and February Payment hereunder. This suspension shall not apply to any Services cancelled by the Board with respect to Route and Field Trip Payments hereunder and Section 22 of the Original Agreement shall be in full force and effective upon expiration of the Amendment Period.
Cancellation of Services. A. If the Center cancels services for any reason, the Center shall provide the Contractor a minimum of twenty-four (24) hours’ notice prior to schedule start time, without incurring any costs. If the services are cancelled less than twenty-four (24) hours before scheduled start time, the Center shall pay the Contractor for the minimum number of hours as stated on the Bid Response Form. Any cancelation of service shall be in writing (email/fax) to the Contractor.
B. The Center may declare services for any event to be concluded immediately, upon its discretion. If the conclusion of services occurs prior to the expiration of the minimum hours, the Contractor shall be paid for the minimum number of hours noted in the Bid Response Form. If the conclusion of services occurs after the expiration of the minimum hours, the Contractor shall be paid for the minimum number of hours plus any full or partial hour after such conclusion of services. A partial hour shall be paid prorated to the half-hour.
Cancellation of Services. You cannot cancel or get a refund for after sales services (such as maintenance, repair and training services) once we start performing the services. You will also be unable to cancel extended warranty and enhanced warranty services once you have started using the service. The Extended Warranty will automatically be cancelled if you submit a claim you know to be false, fraudulent or a misrepresentation.
Cancellation of Services. Subject to the provisions of subsections 11.6, 11.7 and 11.9, Videotron may terminate this agreement at any time upon at least thirty (30) days’ prior notice to the customer.
Cancellation of Services. Except as set forth in Section 7 below, either party may at any time terminate the performance of all or any portion of the Services to be provided hereunder upon thirty (30) days prior written notice to the other stating its intention to terminate and specifying the portion of the Services to be terminated and the date upon which such termination shall be effective.
Cancellation of Services.
(a) If the Customer wishes OptiComm to cancel an existing Service under this Agreement, it will submit to OptiComm a Service Request setting out:
(i) the address of the Service being cancelled;
(ii) the Service identification number;
(iii) the date by which the cancellation is to take effect; and
(iv) any other relevant information.
(b) Subject to clause 4.1(c) if the Customer cancels a Service during the Service Term, it must pay any applicable Service Cancellation Fees in accordance with clause 7.3.
(c) The Customer may cancel a Service immediately, and without incurring any additional charges if:
(i) OptiComm breaches an essential clause of this Agreement which is not resolved within 14 days of the Customer requesting OptiComm to do so in writing or which is unable to be resolved;
(ii) OptiComm become insolvent, bankrupt or unable to pay its debts when due; or
(iii) The Service has been suspended for 14 days, where there is no fault on the Customer's or an End-user's part.
Cancellation of Services. The secondary employer agrees that 24 business hours’ (0800-1700) notice is required to cancel requested services. Services cancelled less than 24 business hours in advance will require a payment for three (3) hour's salary plus administrative costs. Notice maybe provided by contacting the assigned scheduler for this detail. Deputies hired to work secondary employment are bound to the policies and procedures of the Clay County Sheriff’s Office, and are obligated to enforce state statutes and ordinances of Clay County.
Cancellation of Services. Electronic delivery of your statements, notices and disclosures will be terminated if you or VyStar terminate your VyStar Internet Banking access. Refer to the Internet Banking Agreements and Disclosures for additional information. After termination of Internet Banking access, paper statements, notices and disclosures will be mailed to the address on file for your account.
Cancellation of Services. You may cancel Services by writing to Mission Fed, Contact Center, P.O. Box 919023, San Diego, CA 92191, sending a secure message through Mission Fed Online Banking, telephoning us at 858.524.2850 or 800.500.6328 or visiting any branch. Please note that it takes up to 10 (ten) business days to process a cancellation request. Termination will not affect your liability or obligations under these Agreements and Disclosures for transactions already processed on your behalf. We may terminate your use of the Services, in whole or in part, for any reason at any time without prior notice. Your access may, for example, be terminated if any of your accounts are closed or access to any of your accounts is restricted, for any reason. We reserve the right to discontinue your enrollment in the Services after 6 months of inactivity.
