Common use of Capacity and Duties Clause in Contracts

Capacity and Duties. (a) Executive shall serve as President and Chief Executive Officer of the Company. Executive shall continue to serve in all other offices and directorships he now holds with the Company and its subsidiaries, subject to the pleasure of the Boards of Directors of the Company and its subsidiaries. Executive shall perform such other duties and shall have such authority consistent with his position as may from time to time be specified by the Board of Directors of the Company.

Capacity and Duties. (a) Executive shall serve as President and Chief Executive Officer of the Company. Executive shall continue to serve in all other offices and directorships he now holds with the Company and its subsidiariesand, subject to the pleasure supervision and control of the Boards of Directors Chairman of the Company shall have the duties and its subsidiariesauthority generally consistent with such office. Executive shall perform such other duties and shall have such authority consistent with his position as may from time to time be specified by the Board of Directors Chairman of the CompanyCompany as shall be consistent with the status and authority of his current office. Executive currently serves as a Class C Trustee of the Trust.

Executive shall continue to serve in all other offices and directorships he now holds with the Company and its subsidiaries("CEO") and, subject to the pleasure supervision of the Boards Company's Board of Directors of (the Company and its subsidiaries. Executive "Board"), shall perform such other duties and shall have such authority as are consistent with his position as CEO and shall perform such other duties as may from time to time reasonably be specified by the Board of Directors of Company's Board. As CEO Executive shall report directly to the CompanyBoard.

Executive shall perform such other duties and shall have such authority consistent with his position as may from time to time be specified by the Board of Directors of the Company.

Executive shall continue to serve in all other offices and directorships he now holds with the Company and its subsidiaries, subject to the pleasure of the Boards of Directors of the Company and its subsidiaries. Executive shall perform such other duties and shall have such authority consistent with his position as may from time to time reasonably be specified by the Board of Directors or the Chief Executive Officer of Company. Executive shall report directly to the Chief Executive Officer of Company.

Capacity and Duties. (a) Executive shall serve as President Executive Vice President-Acquisitions and Chief Executive Officer Secretary of the Company. Executive shall continue to serve in all other offices and directorships he now holds with the Company and its subsidiariesand, subject to the pleasure supervision and control of the Boards of Directors of Chief Executive Officer, shall have the Company duties and its subsidiariesauthority generally consistent with such offices. Executive shall perform such other duties and shall have such authority consistent with his position as may from time to time be specified by the Board Chief Executive Officer and as shall be consistent with the status and authority of Directors of the Companyhis current offices.
