Capacity Rights and Demand Response Programs. ESCO and the School District agree that the School District shall own, and may assign in its sole discretion, all Capacity Rights associated with the ECMs, and that all payments available to the School District from its participating in regional transmission organization’s demand reduction programs will not be included within any calculation of savings, or otherwise, to reduce the ESCO’s responsibility for achieving the Energy Savings Guarantee.
