Energy Savings Guarantee. The ESCO has formulated and guaranteed the level of energy and operating cost savings which shall be achieved as a result of the performance by the ESCO of the services specified in this Agreement utilizing the Savings Calculation Methodology set forth in Schedule B. The ESCO has structured the Energy Savings Guarantee so as to be sufficient to cover, from the Acceptance Date to the #20th# anniversary of the Acceptance Date:
Energy Savings Guarantee. Pursuant to 62 Pa. Const. Stat. § 3754(b) of the Pennsylvania Guaranteed Energy Savings Act, ESCO guarantees that the Total Guaranteed Savings will meet or exceed the cost of the Selected ECMs. Additionally, ESCO guarantees that the Annual Guaranteed Savings set forth on an annual basis in Schedule C (Energy Savings Guarantee) shall be achieved on an annual basis. The guarantees made in the Section 5.5 constitute the “Energy Savings Guarantee.”
Energy Savings Guarantee. Company has formulated and provided a written Guarantee that the Energy Cost Savings will meet or exceed the costs of the Energy Conservation Measures pursuant to Section 489.145(4)(c), Florida Statutes, and that the amount of any actual annual savings meet or exceed total annual contract payments made by the agency for the contract pursuant to Section 489.145 (3)(d)(2), Florida Statutes. The Guarantee is attached as Schedule C, providing the annual level of Energy Cost Savings to be achieved as a result of the Energy Conservation Measures provided for in this Contract and in accordance with the Savings Calculation Formula as set forth in Schedule F, which is calculated in compliance with Florida law. The Guarantee is set forth in annual increments for the term of the Contract as specified in Schedule C and has been structured so as to be sufficient to cover any and all annual payments required to be made by the Agency as set forth in Schedule D (Compensation to Company) and, if applicable, Schedule L (Financing Agreement).
Energy Savings Guarantee. The Contractor hereby agrees to annually reimburse the Owner for the difference between the annual guaranteed energy savings and the actual annual energy savings realized by Owner in that year, as calculated in accordance with Exhibit B Energy Savings Guarantee and Measurement and Verification Plan. The Energy Savings Guarantee shall extend for the fifteen (15) year period following Owner’s Final
Energy Savings Guarantee. RES has formulated and, subject to the adjustments provided for in Section 15, has guaranteed the annual level of energy, operations and avoided capital cost savings to be achieved as a result of the installation and operation of the Equipment and other energy saving measures provided for in this Agreement (“Energy Savings Guarantee”). The Energy Savings Guarantee is set forth in annual increments for the term of the Agreement as specified in Schedule C and has been structured by RES so as to be sufficient to cover any and all annual payments required to be made by the Customer as set forth in Schedule D.
Energy Savings Guarantee. GRP|WEGMAN has formulated and, subject to the adjustments provided for in Section 14, guaranteed the energy consumption, operating costs, and operational savings to be achieved as a result of the installation and operation of the Work and equipment and services provided for in this Contract. The Energy Savings Guarantee for the Work performed under this Contract is specified in Schedule B (Energy Savings Guarantee). All or some portion of the Energy Savings Guarantee may consist of energy and operations savings stipulated to by the District and GRP|WEGMAN (Stipulated Savings). These Stipulated Savings shall be based on GRP|WEGMAN’s customary standards and methodologies and include avoided maintenance, avoided capital investments, operational savings or avoided personnel costs. The District and GRP|WEGMAN acknowledge that Stipulated Savings are being used to avoid the high costs for measuring the categories of savings included in the parties’ stipulation. The District acknowledges that it has evaluated sufficient information to accept the determination of Stipulated Savings contained in the Energy Savings Guarantee of this Contract. The Stipulated Savings shall be deemed achieved on the date the District accepts and signs GRP|WEGMAN’s Certificate of Substantial Completion. The parties agree that Stipulated Savings shall not be measured or monitored at any time in connection with the Energy Savings Guarantee.
Energy Savings Guarantee. A. Subject to the provisions of Section 6 hereof, Contractor guarantees that Client will realize EC Savings from the EC Measures during the Term of this Agreement of not less than Total Project Costs (as set forth in Schedule K). If the EC Savings realized do not meet or exceed the Total Project Costs, Contractor guarantees to make payment of any shortfall to Client in accordance with the terms of this Section. Additionally, Contractor shall obtain a guarantee of the payment of any shortfall in EC Savings from Westar.
Energy Savings Guarantee. 19.1 The Parties agree that the ESCO shall not in any circumstances be at risk for any increased costs incurred by the Customer (or its Tenants) as a result of any changes to the tariff or charges payable for energy and water consumption, as may be imposed by the Dubai Electricity and Water Authority or the relevant utility company or supplier from time to time. For the avoidance of doubt, the Energy Savings will be calculated based on the fixed tariff rates for energy and water consumption specified in Schedule 9 (Baseline Energy Consumption, Baseline Unit Rates and Baseline Energy Cost), notwithstanding any subsequent increase in those rates during the Term.
Energy Savings Guarantee. ESCO has formulated and, subject to the adjustments provided for in Section 14, (Material Changes) has guaranteed the annual level of energy and operations savings to be achieved as a result of the installation and operation of the Equipment and provision of services provided for in this Contract as specified in Schedule J (ESCO's Maintenance Responsibilities) and in accordance with the Savings Calculation Formula as set forth in Schedule F (Savings Calculation Formulae; Methodology to Adjust Baseline). The Energy Savings Guarantee is set forth in annual increments for the term of the Contract as specified in Schedule C (Energy Savings Guarantee).

The amount of the Energy Savings Guarantee is set forth in annual increments for the term of the Agreement as specified in the “Cash Flow Analysis Table” in Schedule B and has been structured by RES so as to be sufficient to cover any and all annual payments required to be made by the Customer as set forth in Schedule D.
