Common use of Carryover Loss Clause in Contracts

Carryover Loss. If the Phase I Net Profit calculation set forth in Section 9.2(a) above yields a negative number, then (i) ORA shall receive no payments with respect to the completion of Phase I and, (ii) to the extent that such calculation yields a negative amount, such negative amount shall be reflected in the Net Profit Calculation of the next Sale as a Carryover Loss.

If the Phase I II Net Profit calculation set forth in Section 9.2(a9.3(a) above yields a negative number, then (i) ORA shall receive no payments with respect to the completion of Phase I II and, (ii) to the extent that such calculation yields a negative amount, such negative amount shall be reflected in the Net Profit Calculation of the next Sale as a Carryover Loss.

If the Phase I III Net Profit calculation set forth in Section 9.2(a9.4(a) above yields a negative number, then (i) ORA shall receive no payments with respect to the completion of Phase I III and, (ii) to the extent that such calculation yields a negative amount, such negative amount shall be reflected in the Net Profit Calculation of the next Sale as a Carryover Loss.
