Common use of Cash Management System Clause in Contracts

Cash Management System. The summary of the Cash Management System attached hereto as Schedule 3.1P is accurate and complete in all material respects as of the Closing Date and does not omit to state any material fact necessary to make the statements set forth therein not misleading. No Borrower has any Deposit Account which is not described in Schedule 3.1P other than Deposit Accounts permitted to be owned after the Closing Date pursuant to subsection 5.10. There has been no change to the Cash Management System since the Closing Date except such changes as are permitted under subsection 5.10 and such other changes as have been disclosed to Lenders in writing and approved by Administrative Agent.

Cash Management System. No Borrower has any Deposit Account which is not described in Schedule 3.1P 4.1P other than Deposit Accounts permitted to be owned after the Closing Date pursuant to subsection 5.106.10. There has been no change to the Cash Management System since the Closing Date except such changes as are permitted under subsection 5.10 6.10 and such other changes as have been disclosed to Lenders in writing and approved by Administrative Agent.

The summary of the Cash Management System Borrowers' cash management system attached hereto as Schedule 3.1P SCHEDULE 6.21 is accurate and complete in all material respects as of the Closing Date and does not omit to state any material fact necessary to make the statements set forth therein not misleading. No Borrower has nor any of its Subsidiaries owns any Deposit Account which is not described in Schedule 3.1P other than Deposit Accounts SCHEDULE 6.21 or otherwise permitted to be owned after the Closing Date pursuant to subsection 5.10SECTION 7.10. There has been no change to the Cash Management System cash management system (other than as permitted by SECTION 7.10) since the Closing Date except such changes as are permitted under subsection 5.10 and such other changes as have been disclosed to Lenders the Agent in writing and approved by Administrative the Agent.

No Borrower has Loan Party nor any of its Subsidiaries owns any Deposit Account which relates to any Mortgaged Property that is not described in Schedule 3.1P other than Deposit Accounts 4.23 or otherwise permitted to be owned after the Closing Date pursuant to subsection 5.105.15. There has been no change to the Cash Management System (other than as permitted by subsection 5.15) since the Closing Date except such changes as are permitted under subsection 5.10 and such other changes as have been disclosed to Lenders the Agent in writing and approved by Administrative the Agent.
