Recently, the Plaintiff came up with a new theory that the tank was not set back sufficiently pursuant to the Railroad Commission Rules, but Defendant, Xxx Xxxxxxxxx, has discussed this with the Railroad Commission and states that the Railroad Commission agrees with him that the setback is proper. Once this has been confirmed in writing from Railroad Commission, the case against Sonterra will be over.
