Certain Provisions of the Charter. The Charter will, when approved, authorize the School to operate and receive the federal, state and local education funds identified in this Agreement, as well as other revenues, and otherwise vests the Council with all powers necessary and desirable for carrying out the Program and other activities contemplated in this Agreement. The Council will use its best efforts to seek approval from the Charter Authorizer to extend the Program to additional grade levels and to increase the authorized enrollment of the Program, unless doing so would be contrary to the Council’s fiduciary duties.
