Common use of Certifications and Assurances Clause in Contracts

Certifications and Assurances. (a) CONSULTANT shall adhere to the requirements contained in HCAOG’s annual Certification and Assurances (FHWA and FTA “Regional Transportation Planning Process Certification”) submitted as part of HCAOG’s OWP, pursuant to 23 CFR 450.334 and 23 U.S.C. 134. This Certification shall be published annually in HCAOG’s OWP when federal funds are used. Such requirements shall apply to CONSULTANT to the same extent as HACAOG and may include, but are not limited to: i. Title VI of the Civil Rights Act of 1964 and Title VI Assurance executed by California under 00 X.X.X. 000 xxx 00 X.X.X. 000; ii Pub. Law 105-178, 112 Stat. 107 and any successor thereto, regarding the involvement of disadvantaged business enterprises in FHWA and FTA funded projects (Sec. 105(f), Pub. L. 970424, 96 Stat. 2100, 49 CFR part 26); and
