Container Freight Station Supplement 59 CFS Wage Schedules 68 ADDENDA CFS Program Fund 69 Dispatch Hall Costs 69 Favored Nations 70 Employer Contribution to 401(k) Savings Plan 71 Guarantees for All Walking Bosses/ Foremen 71 LETTERS OF UNDERSTANDING Letters of Understanding from PMA to ILWU 72 INDEX Subject Index 87 ILWU-PMA PACIFIC COAST WALKING BOSSES and FOREMEN’S AGREEMENT THIS AGREEMENT, effective July 1, 1999, is by and between PACIFIC MARITIME ASSOCIATION (herein called the “Association”), on behalf of its members (here- inafter designated as the “Employers” or “the individual employer”), and Locals 91, 92, 94 and 98, and Units 29 and 46 of the International Xxxxxxxxx and Warehouse Union (hereinafter designated as the “Union”), said Locals and Units representing the Walking Bosses and Foremen in Cal- ifornia, Oregon and Washington, and all employees per- forming work under the scope, terms and conditions of this Agreement. The parties hereto are Locals 91, 92, 94 and 98 and Units 29 and 46 of the International Xxxxxxxxx and Warehouse Union and the Pacific Maritime Association. All property rights in and to the Pacific Coast Walking Bosses and Fore- men’s Agreement are entirely and exclusively vested in the Pacific Maritime Association and Locals 91, 92, 94 and 98 and Units 29 and 46, respectively, and their respective members. In the case of the above named Locals and Units of the International Xxxxxxxxx and Warehouse Union, a ma- jority of the members of both the individual and combined Locals and Units covered by this Agreement shall be nec- xxxxxx to designate any successor organization holding property rights and all benefits of this Agreement, and if an JURISDICTION AND RESPONSIBILITIES SECTION 1 HOURS AND SHIFTS SECTION 2 election is necessary to determine a majority of both indi- vidual and combined Locals and Units in order to establish the possessors of all rights and benefits under this Agree- ment, such election shall be conducted under the auspices and the supervision of the Coast Arbitrator, provided that such designation or election is not in conflict with any para- mount authority or lawful or statutory requirements.
