Common use of Change of Operations Clause in Contracts

Change of Operations. ‌ Where new types of equipment are used which change the operations of the Department, new classifications are created, or the duties of an existing classification are substantially changed, the wages, hours, and working conditions covering such operation or classification shall be negotiated between the parties. In the event that negotiations cannot be finalized to the satisfaction of both parties, the issue shall be submitted to the Human Resources Department for its determination. Rates agreed upon or awarded shall be effective as of the date the job classification becomes effective. Establishment of wage rates under this section is subject to grievance and/or arbitration.
