Common use of Change of Supplier and Customer Designation to Control Clause in Contracts

Change of Supplier and Customer Designation to Control. If a Customer wishes to change Supplier and the new Supplier agrees to serve the Customer, the Customer’s new Supplier shall obtain appropriation authorization from the Customer or person authorized to act on the Customer’s behalf indicating the Customer’s choice of Supplier, and shall thereupon follow the Procedure in Section 8.3 to Formalize Selection of Supplier. Once the preceding process is complete, the Company will notify the Customer’s prior Supplier that the Customer has elected to terminate service from that Supplier. Supplier acknowledges and agrees that the Company will give effect to all Customer requests to change to a new Supplier, and consequently the most recent Customer designation of a Supplier, for which the procedures under Section 8.3 have been completed, will be given effect by the Company.
