Common use of CHANGES IN AND VARIABLE LOADS Clause in Contracts

CHANGES IN AND VARIABLE LOADS. (a) In the event the consumer desires to add a new load or change the load materially, the consumer shall notify the Cooperative sufficiently in advance so that the Cooperative may, if economically feasible, accommodate the change in load. If the consumer fails to notify the Cooperative and, as a result, the Cooperative’s equipment is damaged, the consumer shall be liable for the cost of such damage. (b) The Cooperative may require the advance payment of contributions or advances-in-aid of construction and the execution of related documents as outlined in Section 20 (Line Extension Policy) of this Tariff prior to the commencement of any installation of added or enlarged facilities to accommodate the change in load. (c) The Cooperative may require consumers with highly variable load requirements to provide or install safety equipment at the consumer’s expense to protect the Cooperative’s property See also Section 12.9 (Unusual Load Characteristics).
