Changes to the Utilities Commission Act. In the event that the provisions of the Utilities Commission Act or other legislation affecting the rights and powers of regulated Utilities change in such a way as to materially, in FortisBC’s opinion, affect FortisBC’s powers in respect to matters dealt with in this Agreement, (a) FortisBC may within one year of the change coming into effect propose new agreement terms with respect to only those specific changes and the Municipality agrees to negotiate such terms; and (b) failing satisfactory resolution either of the parties will seek resolution through the Dispute Resolution Process, Section 17.
