CHARGES TO THE ACCOUNT OF NEVADA JV. Subject to Section 4.2(a)(ii) of the Agreement and other provisions of the Agreement, Nevada JV shall compensate the Operating Member for all costs and expenses incurred directly by the Operating Member or its Affiliates in the performance of Operations on behalf of Nevada JV. The Operating Member shall be provided with funds in advance or be reimbursed by Nevada JV for any such costs or expenses. Subject to the provisions hereof and of the Agreement, the Operating Member shall charge to the accounts of Nevada JV (the “Operations Accounts”) the following, with the term “Operating Member” with respect to reimbursable expenditures being deemed to include the Operating Member or any Affiliate thereof:
