Chief executive officer resolution. (a) Within ten Business Days after the giving of a Dispute Notice any Dispute must be referred in the first instance to the chief executive officer of Aurizon Network (or their nominee) and the chief executive officer of the Customer (or their nominee) for the purposes of this clause 15.2 for resolution.
(b) If the Dispute is not resolved within ten Business Days after the referral under clause 15.2(a) or in the event that any chief executive officer appoints a nominee that is unacceptable to the other Party, then the relevant Dispute:

(a) Within ten Business Days after the giving of a Dispute Notice (or in the case of a Discrimination Dispute, if the Discrimination Dispute is not resolved within ten Business Days after referral under clause 19.2(d)), any Dispute must be referred in the first instance to the chief executive officer of the Landholder (or his or her nominee) and the chief executive officer of the Trustee (or his or her nominee) for the purposes of this

(b) If the Dispute is not resolved within ten Business Days after the referral under clause 8.2(a) or in the event that any chief executive officer appoints a nominee that is unacceptable to another Party, then the relevant Dispute:
(i) must, where this Agreement expressly requires referral to an expert; and
(ii) may, by agreement of the Parties in any other case, be referred for resolution by an expert (Expert) in accordance with

(b) If the Dispute is not resolved within ten Business Days after the referral under clause 16.2(a) or in the event that any chief executive officer appoints a nominee that is unacceptable to the other Party, then the relevant Dispute:
(i) must, where this Agreement expressly requires referral to an expert; and
(ii) may, by agreement of the Parties in any other case, be referred for resolution by an expert (Expert) in accordance with
Chief executive officer resolution. Within ten Business Days after the giving of a Dispute Notice by any person referred to in clause 5.1 in respect of a Dispute under a Transaction Document, the Dispute must be referred in the first instance to:
Chief executive officer resolution. (1) Within 20 Business Days after the giving of a Dispute Notice, any Dispute must be referred in the first instance to the chief executive officer (or a nominee appointed by the chief executive officer with the authority to settle the Dispute on behalf of the relevant party) of each party who must negotiate in good faith for resolution of the Dispute.
(2) If the Dispute is not resolved within 20 Business Days after the referral under clause 9.2(a), or in the event that either chief executive officer appoints a nominee that is unacceptable to the other parties to the Dispute, then the relevant Dispute: ME_212469013_16
(1) must, if the Dispute arises between the Parties solely in relation to the calculation of the Royalty payable by the Grantor to the Royalty Holder under this Deed or in connection with an Audit; and
(2) may, in any other case, by agreement of the parties, be referred for resolution by an expert (Expert) in accordance with clause 9.3, or, in all other cases, may be determined in accordance with clause 9.5.
Chief executive officer resolution. (a) Within ten Business Days after the giving of a Dispute Notice by any person referred to in clause 5.1 in respect of a Dispute under a Transaction Document, the Dispute must be referred in the first instance to:
(i) the chief executive officer of Aurizon Network (or his or her nominee);
(ii) the chief executive officer of the Trustee (or his or her nominee);
(iii) if the Unit Holder is party to the relevant Transaction Document, the chief executive officer of the Unit Holder (or his or her nominee); and
(iv) in relation to a Dispute under an Access Agreement Specific Xxxxx Xxxx, the chief executive officer of the applicable Access Seeker (or his or her nominee), for resolution.
(b) If the Dispute under a Transaction Document is not resolved within ten Business Days after the referral under clause 5.2(a), or in the event that any chief executive officer appoints a nominee that is unacceptable to another party to the relevant Transaction Document, then the relevant Dispute:
(i) must, where the relevant Transaction Document expressly requires referral to an expert; and
(ii) may, by agreement of the parties to the relevant Transaction Document in any other case, be referred for resolution by an expert (Expert) in accordance with clause 5.3.
Chief executive officer resolution. (a) Within ten Business Days after the giving of a Dispute Notice (or in the case of a Discrimination Dispute, if the Discrimination Dispute is not resolved within ten Business Days after referral under clause 16.2(d)), any Dispute must be referred in the first instance to the chief executive officer of Aurizon (or his or her nominee) and the chief executive officer of the Trustee (or his or her nominee) for the purposes of this clause 16.3 for resolution.
(b) If the Dispute is not resolved within ten Business Days after the referral under clause 16.2(a) or in the event that either chief executive officer appoints a nominee that is unacceptable to the other Party, then the relevant Dispute:
(i) must, where this Agreement expressly requires referral to an expert; and
(ii) may, by agreement of the Parties in any other case, be referred for resolution by an expert (Expert) in accordance with clause 16.4.
Chief executive officer resolution. (a) Within ten Business Days after the giving of a Dispute Notice any Dispute must be referred in the first instance to:
(i) the chief executive officer of Aurizon Network (or his or her nominee);
(ii) the chief executive officer of the Trustee (or his or her nominee); and
(iii) if the Unit Holder is party to the Transaction Agreement subject to the Dispute, the chief executive officer of the Unit Holder (or his or her nominee), and for the purposes of this clause 6.2 for resolution.
(b) If the Dispute is not resolved within ten Business Days after the referral under clause 6.2(a) or in the event that any chief executive officer appoints a nominee that is unacceptable to another party to the Transaction Document under Dispute, then the relevant Dispute:
(i) must, where the Transaction Document under Dispute expressly requires referral to an expert; and
(ii) may, by agreement of the parties the Transaction Document under Dispute in any other case, be referred for resolution by an expert (Expert) in accordance with clause 6.3.
